Terms of Service

1. Acceptance of these terms

Roomed is a product of Mellosoft Pty Ltd ("Mellosoft", "we", "our" or "us"). By creating an account or using Roomed you agree to these terms. You must be at least 18 years old and able to form a binding contract to use the service.

2. The service

Roomed is a rent and bond tracking tool for self-managed landlords. Roomed can also collect rent on your behalf: each rent cycle your tenant receives a payment link by email, can pay from their bank account, and receives a receipt. We may modify, suspend or discontinue any part of the service at any time. Where a change materially reduces what you have paid for, we will tell you first.

3. Your account and your data

You agree to provide accurate information, to keep your sign-in method secure and that you are responsible for activity under your account. You own the data you enter into Roomed. You grant us the rights needed to store and process that data to operate the service, and nothing more. You confirm that you are entitled to record the tenant details you enter, and to have payment requests and receipts sent to the tenant contact details you provide.

4. Fees

The core of Roomed is free: properties, rooms, tenancies, manually recorded payments and reminders.

• Rent collection carries a fee of 1.5% of each payment Roomed collects by bank debit (PayTo or BECS direct debit), 2.5% of each payment collected by card, or another rate we agree with you in writing. The fee is GST inclusive and is deducted before the payout to you. There is no other charge: no monthly fee, no setup fee and no fee to your tenant.
• If Roomed does not collect a payment, you pay nothing for it. Rent you record yourself is always free.
• Fees may change. We will give you notice, and a change applies from the next payment collected after it takes effect.

5. Not financial, legal or tax advice

Roomed is a record-keeping tool. Paid-to dates and arrears are derived from the payments you record and the payments Roomed collects, and may be incomplete or wrong. Payment processing and settlement take time, so a payment your tenant has made may not appear in your records or your account immediately. Verify your records before acting on them, for example before issuing a breach notice.

6. Acceptable use

You agree to use Roomed only to manage properties you are entitled to manage. You must not attempt to access data belonging to others, interfere with the operation of the service, use it for any unlawful purpose or resell it.

7. Termination

You can stop using Roomed at any time, and can delete your account and data from the app's settings or by contacting hello@mellosoft.com.au. We may suspend or terminate an account that breaches these terms.

8. Disclaimer of warranties

To the extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind. Nothing in these terms excludes the consumer guarantees under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by applicable law, Mellosoft Pty Ltd is not liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or business opportunity, arising out of or relating to your use of the service. Our aggregate liability arising out of or relating to these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in this section limits rights under the Australian Consumer Law that cannot be excluded.

10. Governing law

These terms and your use of Roomed are governed by the laws of Western Australia. Any dispute arising from these terms or the service is subject to the exclusive jurisdiction of the state and federal courts located in Western Australia.

11. Changes to these terms

We may revise these terms from time to time. The current version is always posted on this page. If a revision is material, we will notify you at the email address on your account. Continuing to use Roomed after a revision takes effect means you accept the updated terms.
